Social media startup Fizz is suing Instacart and Partiful for trademark infringement over the new Fizz drink and snacks ordering app.

Fizz, the social app, is demanding an immediate halt to Instacart’s use of the Fizz name and is seeking damages. According to the lawsuit, Fizz has used the name since January 2022. However, it only filed for trademark registration in 2024, with applications still pending.

Instacart is launching a new, Gen-Z focused app for group orders of drinks and party snacks, expanding its core delivery business beyond grocery hauls.
